Users may contact the Foundation via the general contact form available on the Website, without prejudice to any other channels that may be made available and published from time to time.
2. PURPOSE AND SCOPE OF APPLICATION
These Terms of Use govern access to, browsing of and use of the Website, as well as the features and services that the Foundation makes available to its Users. The Website provides information about the Banco Santander Foundation’s cultural centre, known as Faro Santander (“Faro Santander”), its facilities, exhibitions, activities, events and cultural programme.
The Website will also allow users to purchase tickets for certain Faro Santander events, exhibitions or activities; submit enquiries and requests via the forms for the press, organisations, venue bookings or hire, and user support; voluntarily subscribe to newsletters about the Banco Santander Foundation and Faro Santander’s activities; and access links, content or digital platforms belonging to third parties, including social media, websites of authors, contributors, associations or other organisations.
Certain features are governed not only by these Terms of Use but also by specific terms and conditions. For example, the purchase of tickets is governed by the General Terms and Conditions of Purchase, which will be made available to the User before the transaction is completed. The processing of personal data is governed by the Privacy Policy, and the use of cookies and similar technologies is governed by the Cookie Policy.
3. ACCEPTANCE OF THE CONDITIONS OF USE
Accessing and using the Website confers the status of user user upon the person doing so (hereinafter, the “User” or the “Users”). Users must read these Conditions of Use carefully before using the Website. By accessing and browsing the Website, Users agree to be bound by the applicable provisions, although the use of, or subscription to, certain services may require the express acceptance of specific conditions.
Where a particular feature requires the User's express acceptance of specific conditions, those conditions will be made available to the User before they carry out the relevant action. The Foundation may, in the future, introduce private areas, user accounts, loyalty programmes or other features subject to prior registration, in which case it will first update these Terms of Use and inform Users of the specific conditions applicable.
General browsing of the Website is not subject to a specific minimum age. However, minors must use it under the supervision of their parents, guardians or legal representatives where necessary.

5. INFORMATION AVAILABLE ON THE WEBSITE
The Foundation endeavours to ensure that information relating to Faro Santander, its exhibitions, activities, events, venues and services is accurate, comprehensive and up to date. However, certain information may be subject to change for artistic, organisational, technical, operational or force majeure reasons; amongst other things, dates and times, the programme, participants, artists or speakers, ticket availability, conditions of access, capacity limits, the venues used or the services offered may vary.
Where such changes affect a ticket that has already been purchased or a service that has already been contracted, the provisions of the applicable contractual terms and conditions and current legislation shall apply.
Content published on the Website for purely promotional or informational purposes shall not in itself constitute a contractual offer, unless expressly stated otherwise.
6. WEBSITE FORMS
The Website may include forms designed to facilitate contact with the Foundation and to initiate the processing of applications relating to Faro Santander. Submitting any such form requires the provision of truthful, accurate and sufficient information, and its use must be in accordance with the specific purpose of each form. The mere submission of a form shall not imply automatic acceptance of the application or the conclusion of a contract, unless expressly stated otherwise
6.1. Press contact form
The Press Contact Form enables journalists, media organisations and other media professionals to submit enquiries, request information or contact the Foundation's communications team. Submission of the Press Contact Form shall not, in itself, constitute the granting of press accreditation, the reservation of a place, authorisation to access restricted areas, authorisation to take photographs or make recordings, or the granting of any rights to reproduce content, works or facilities.
The inclusion of an applicant in a permanent press contact database shall require that such processing is compatible with the information provided and has an appropriate legal basis. The specific conditions applicable to any press accreditation or press activity must be expressly confirmed by the Foundation.
6.2. Group Visits Enquiry Form
The Group Visits Enquiry Form enables users to request information or initiate arrangements for visits and activities intended for schools, associations, organisations and other groups. Submission of the Group Booking Enquiry Form shall not, in itself, constitute acceptance of the request, guarantee the availability of a particular date and time, the reservation of places, the application of a specific fee, the booking of the activity or the availability of specific services.
The Foundation will contact the applicant to process the request and, where applicable, provide information on the applicable requirements and conditions. Where the request relates to minors, the person submitting it must have the necessary legal capacity, authority or authorisations to act on behalf of the group and provide the relevant information. If accessibility arrangements or information are requested, only the data strictly necessary to ensure the proper organisation of the activity should be provided.
6.3. Venue Booking Form
The venue booking form will enable individuals or legal entities to request information on the availability and conditions of use of the venues at Faro Santander. Submission of the form does not imply acceptance of the request, does not guarantee availability, does not constitute a firm booking, does not entail the conclusion of a contract and does not, in itself, generate a right to use the venue.
The Foundation may review the proposed activity and request further information regarding the applicant’s identity, dates and times, number of attendees, technical requirements, set-up and dismantling, additional services, security, insurance and the potential use of trademarks, images or content. The Foundation may accept or reject the application in accordance with objective, organisational, technical, reputational, security or availability criteria. If the application is accepted by the Foundation, the parties shall formalise the relevant contract for the hire, assignment or use of spaces outside the Website.
6.4. Customer Support Form
The Foundation will make a contact form available to Users to handle enquiries, complaints, claims, incidents and suggestions relating to the Website and the services offered by Faro Santander. The User must provide sufficient, truthful and accurate information so that the request can be identified and processed.
Where the enquiry relates to a purchase, the necessary information to identify the transaction must be provided, without disclosing full card details, payment credentials or any other information that has not been expressly requested. The Foundation will endeavour to respond as soon as possible, taking into account the nature and complexity of the request. Enquiries specifically relating to data protection must be submitted via the channels indicated in the Privacy Policy.
6.5. Subscription to newsletters
Users who wish to do so may complete the form to request informative communications about the Banco Santander Foundation and the activities of Faro Santander. This request constitutes the User’s consent, which shall be voluntary, independent of the use of other services, revocable, and shall not constitute a requirement for browsing the website, purchasing tickets or submitting other forms.
The communications sent may be personalised according to the User’s specific characteristics and interests, as described in the Privacy Policy.
The User may withdraw their consent or unsubscribe using the mechanism included in the communications or via the channels set out in the Privacy Policy. Withdrawal will not affect the lawfulness of any processing carried out previously.
7. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

When the User provides the Foundation, via the forms or features made available, with documents, photographs, images, texts, logos, trademarks or other materials protected by intellectual property rights, industrial property rights, image rights or any other rights, they declare that they hold the necessary rights, licences, authorisations or legal standing to disclose them and to permit their use for the relevant purpose. The Foundation will only use such materials to the extent necessary to process the enquiry, request or service for which they were provided, unless the User is informed and, where required, additional authorisation is obtained.
The User must immediately notify and inform the Foundation of the existence of any content that is unlawful, illegal, contrary to the law or that could constitute an infringement of intellectual and/or industrial property rights of which they become aware, so that the Foundation may take the appropriate measures; such notification must be submitted via the User support form. 8. TERMS OF USE FOR THE WEBSITE
Accessing or using the Website for illegal or unauthorised purposes, whether or not for financial gain, is not permitted; consequently, the User shall be solely liable for any consequences arising therefrom. In particular, and without the following list being exhaustive, the following is prohibited:

9. USER OBLIGATIONS AND RESPONSIBILITIES
The User agrees that they may not use the Website in breach of the provisions of these Terms of Use. The User must also: (i) ensure they have all the necessary technical means and requirements to access the Website and make use of the services available through it; and (ii) provide accurate information when completing the forms on the Website with their personal data, and keep this information up to date so that it reflects the User’s actual circumstances at all times. 10. THE FOUNDATION’S RESPONSIBILITIES AND GUARANTEES
The Foundation endeavours to keep the Website available, secure and up to date; however, it cannot guarantee the reliability, usefulness or accuracy of all the information contained on the Website.
The Foundation and, where applicable, third-party content or service providers accept no liability arising from the content, products or services offered or provided by third parties via the Website.
In particular, they accept no liability for any loss or damage arising from:

The Foundation declares that it has taken all necessary measures, within its means and in accordance with the state of the art, to ensure the proper functioning of the Website and to minimise system errors, both from a technical perspective and in relation to the content published on the Website.
The Foundation shall not be liable for the accuracy, completeness or timeliness of information published on the Website that originates from sources outside the Foundation, nor for information contained on other websites linked to from the Website.
Furthermore, the Foundation shall not accept any liability for the availability, operation, content or services provided by third-party providers whose services are integrated into or accessible via the Website, including, but not limited to, ticketing platforms, payment gateways, social media platforms or other technology providers, without prejudice to any liabilities to which they may be legally subject.

The Foundation accepts no liability for damages of any kind that may arise from the misuse of the Website. Furthermore, the Foundation is exempt from any liability for content and information that may be received as a result of unlawful or improper use of the Website.

The Foundation’s failure to exercise or enforce any right or provision contained in these Terms of Use shall not constitute a waiver of that right or provision, unless acknowledged and agreed in writing by the Foundation.
15. APPLICABLE LAW AND JURISDICTION
The relationship between the Foundation and the User shall be governed by the applicable laws of Spain, and any dispute arising in connection therewith shall be submitted to the Courts of Madrid, Spain, the parties expressly and voluntarily waiving any other jurisdiction to which they may otherwise be entitled, unless otherwise required by mandatory law.
The Foundation shall take appropriate action in the event of any breach of these Conditions of Use or any improper use of the Website, exercising all civil and criminal remedies available to it under applicable law.
