Faro Santander is a cultural project sponsored by Fundación Banco Santander, the entity responsible for the content and management of this website (hereinafter referred to as the “Website” or the “Site,” interchangeably), accessible via www.farosantander.com

Please read the following general conditions carefully.

 

  1. PURPOSE
    This Website is owned by Fundación Banco Santander, with Tax ID No. G-80576200, located at 57 Serrano Street (Madrid), and registered in the Registry of Foundations of the Ministry of Justice under number 208 (hereinafter, the “Foundation”).
    The Foundation has created this Website to provide interested users with information about the programme of Faro Santander, a new art centre that brings together artistic heritage, technology, and contemporary culture, creating new spaces for discovery, participation, and community.

    REQUIREMENTS FOR ACCESSING, USING, AND ACCESSING THE SITE'S CONTENT, AND MODIFICATIONS TO THE TERMS AND CONDITIONS
    Access to and/or use of the Website is entirely voluntary and grants the status of user to anyone accessing it. All users, whether registered or not, accept, from the moment they access the Website and without any reservation, the content of this Legal Notice, as well as, where applicable, any specific conditions that may supplement, replace, or modify it in relation to the Website’s contents.
    Access to and navigation of the Website must be carried out in accordance with the provisions of this Legal Notice.
    In any case, the Foundation reserves the right to modify or remove the content, structure, design, and conditions of access to and/or use of this Website whenever it deems appropriate, providing prior notice in the event of substantial changes. The Foundation also reserves the right to interpret this Legal Notice in relation to any issues arising from its application.

  2. USER RESPONSIBILITY
    The user shall be solely responsible for the use of the Website and for full compliance with this Legal Notice. By way of example, but not limited to, the user is responsible for:

    1. Registering or providing information that is true, accurate, complete, and/or up-to-date.
    2. Using the content provided by the Website in accordance with applicable law, the principles of good faith, and generally accepted practices, and refraining from any actions through the Website that violate public order or the provisions of this Legal Notice. In this regard, the user agrees to make lawful, diligent, honest, and proper use of any information and/or content to which they have access through the Website. Therefore, the following is expressly prohibited:

      • register on the Website using information that infringes on copyrights, trademarks, or rights of confidentiality, privacy, or any other rights, or that is otherwise defamatory or objectionable to third parties;
      • upload or otherwise distribute content that may violate any applicable law or infringe upon the rights of any party.

    The Foundation reserves the right to deny access to the Website and/or to terminate accounts in cases of misuse of the Website, or in the event of a breach of any of the provisions set forth in this Legal Notice or in any applicable specific terms and conditions.

  3. DISCLAIMER OF WARRANTIES AND LIABILITY
    The Foundation does not guarantee nor assume responsibility, under any circumstances, for the following facts and content, nor for any damages that may, if any, arise therefrom:
    1. Lack of availability, continuity, access, maintenance, and proper functioning of the Website, as well as the updating, accuracy, completeness, relevance, timeliness, and reliability of its content; and any technical or other difficulties or problems, provided that such issues are attributable to third parties.
    2. The transmission and/or presence of viruses, other harmful elements, or programs that could affect users’ devices as a result of accessing, using, or browsing the site, or that could cause alterations to their electronic documents or files, provided that such incidents are attributable to third parties.
    3. Any unlawful, negligent, or fraudulent use of the Website by users, or any use that impersonates a third party or violates the terms of this Legal Notice, good faith, generally accepted practices, or public order.
    4. Errors, omissions, flaws, or defects in the information and content accessed through the Website. The Foundation has obtained the information and content included on the Website from sources considered reliable; however, although reasonable measures have been taken to ensure that all information contained therein is correct, the Foundation does not guarantee that it is accurate, complete, or up-to-date, and consequently, it should not be relied upon as if it were. The Foundation reserves the right to modify, suspend, cancel, or restrict the content of the Website, the links, or the information obtained through it, without prior notice.
    The Foundation shall also accept no responsibility for the activities or conduct of users.

    The Website may include links within its content to sites owned and/or operated by third parties in order to facilitate access to information and content available on the Internet.
    The Foundation assumes no liability arising from the existence of links between the Website's content and content located outside of it, or from any other reference to content external to this site. Such links or references are provided for informational purposes only and, under no circumstances, imply any endorsement, approval, commercialization, or relationship between the Foundation and the individuals or entities that create and/or manage such content or own the sites where it is located, nor do they constitute any guarantee by the Foundation regarding the proper functioning of the linked sites or content.
    In this regard, the user agrees to exercise the utmost diligence and caution when accessing or using content from the sites accessed via the aforementioned links.

  5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
    This Faro Santander website is owned by the Foundation. The intellectual and industrial property rights, as well as the rights of use and reproduction, of the Site, its pages, screens, the information they contain, their appearance, structure, and design, audio files, and software, as well as any hyperlinks that may be established from the Site to other web pages of any company belonging to the Santander Group, are owned by, have been assigned to, or are licensed to the Foundation, unless otherwise specified.
    All names, designs, and/or logos appearing on this website are duly registered trademarks. Any unauthorized use of these trademarks by anyone other than their rightful owner may be prosecuted in accordance with applicable law.
    All rights to the Website are protected by international laws and treaties governing intellectual and industrial property. Any reproduction, transmission, adaptation, translation, modification, public communication, or any other use of all or part of the content of this Website, whether in any form or by any means—electronic, mechanical, or otherwise—is strictly prohibited without the Foundation’s prior written authorization. Any infringement of these rights may result in appropriate extrajudicial or judicial civil or criminal proceedings.
    Likewise, the collection of content available on the Website is protected by the sui generis database right established under Royal Legislative Decree 1/1996 of 12 April, approving the revised text of the Intellectual Property Law. Accordingly, users may not extract or re-use all or a substantial part of such content, nor even an insubstantial part where doing so would conflict with the normal use of the content and unjustifiably prejudice the legitimate interests of the Foundation.
    The Foundation does not grant any license or authorization of any kind regarding its intellectual and industrial property rights, or regarding any other property or right related to the Website or its content.
    The validity of the intellectual and industrial property rights pertaining to content provided by third parties is the sole responsibility of those third parties.

  6. DATA PROTECTION
    The email address provided by the user for receiving informational communications regarding relevant news from Faro Santander will be processed by the Foundation as the data controller, based on the consent given by the user to receive such communications. This consent may be withdrawn at any time by requesting to unsubscribe from receiving such communications (through the unsubscribe mechanism provided therein), as well as by exercising the rights granted by data protection regulations, in the manner indicated in this clause.
    The personal data provided will be processed for as long as necessary to fulfil the aforementioned purpose and provided that the user does not withdraw their consent. Once the processing has ended, the personal data of the data subjects will be duly blocked and retained for a period of three years in order to address any potential data protection claims arising from such processing, after which they will be permanently deleted.
    The data of the data subjects may be disclosed to public bodies and authorities where necessary to comply with a legal obligation and/or to exercise the corresponding legal actions, as well as to companies within the Banco Santander Group, exclusively where necessary for the fulfilment of the stated purpose or for internal administrative purposes. In addition, the data may be accessed by the Foundation’s service providers where such access is necessary for the proper fulfilment of the aforementioned purpose. By way of example and without limitation, the Foundation contracts technological services for the operation of its platforms, repositories, etc. Should any of the services contracted by the Foundation involve the processing of personal data outside the European Economic Area, the Foundation guarantees that such processing will be carried out with appropriate safeguards in place.

If we are unable to properly identify you, the Foundation may request additional information.
    Furthermore, data subjects have the right to contact the Spanish Data Protection Agency at the following address: Calle Jorge Juan No. 6, 28001 Madrid, or via www.aepd.es, if they believe that their personal data is not being processed correctly or that their rights have not been properly addressed.

  7. APPLICABLE LAW AND JURISDICTION
    This Legal Notice shall be governed by Spanish law. The Foundation and the user submit to the jurisdiction of the Courts and Tribunals of Madrid Capital in relation to any disputes or actions arising from the contents of the Website, as well as the interpretation, application, compliance with, or breach of the provisions set out in this Legal Notice.
